Limitation of Liability

You understand and agree that, to the fullest extent permitted by law, the RGG Squad Parties will not be liable to you or to any third party for any indirect, incidental, special, consequential, or exemplary damages which you may incur, including, without limitation, any loss of profits (whether incurred directly or indirectly), loss of goodwill or business reputation, loss of data, cost of procurement of substitute goods or services, or any other intangible loss, even if we have been advised of the possibility of such damages, arising out of or in connection with the Terms of Use or any communications, interactions or meetings with other users of the Services, however caused and under any theory of liability, resulting from:

(a) the use or inability to use the Services;

(b) the cost of procurement of substitute goods or services resulting from any goods, data, information, or services purchased or obtained, or messages received, or transactions entered into through the Services;

(c) unauthorized access to or alteration of your transmissions or data;

(d) statements or conduct of any third party on the Services; or

(e) any other matter related to the Services, whether based on warranty, copyright, contract, tort (including negligence), or any other legal theory.

The foregoing limitation of liability shall not apply to liability of an RGG Squad Party for: (i) death or personal injury caused by an RGG Squad Party's negligence; or (ii) any injury caused by an RGG Squad Party's fraud or fraudulent misrepresentation.

You agree and acknowledge that, to the fullest extent permitted by law, the RGG Squad Parties will not be liable to you for more than the greater of:

(a) The total amount paid to RGG Squad by you in the transaction or incident that is the subject of the claim, or (b) One hundred US dollars (US$ 100.00).

You agree and acknowledge that we have made the Services available to you and entered into these Terms in reliance upon the warranty disclaimers and limitations of liability set forth herein. These disclaimers reflect a reasonable and fair allocation of risk between the parties and form an essential basis of the bargain between us. We could not provide the Services to you without these limitations. The foregoing limitations of liability apply to the fullest extent permitted by applicable law.
